1. Acceptance of Terms

By accessing and using Biznix services, you accept and agree to be bound by the terms and conditions of this agreement. If you do not agree to these terms, you should not use our services.

2. Services Description

Biznix provides web development, design, hosting, maintenance, and related digital services. Our services include but are not limited to:

  • Website design and development
  • E-commerce solutions
  • Landing page creation
  • Website maintenance and support
  • Hosting and domain management
  • Full-stack application development
  • Cloud and DevOps solutions

3. Project Scope and Deliverables

3.1 Project Agreement: Each project will be defined through a project agreement or statement of work that outlines:

  • Project scope and deliverables
  • Timeline and milestones
  • Pricing and payment terms
  • Revision policy
  • Support and maintenance terms

3.2 Changes to Scope: Any changes to the agreed project scope must be requested in writing and may result in additional costs and timeline adjustments.

4. Payment Terms

4.1 Pricing: All prices are quoted in Indian Rupees (INR) or US Dollars (USD) and are subject to the terms agreed upon in the project agreement.

4.2 Payment Schedule: Unless otherwise agreed:

  • 50% advance payment required to start the project
  • 50% payment due upon project completion and before final delivery
  • Monthly maintenance plans billed at the beginning of each month

4.3 Late Payments: Late payments may result in project suspension and may incur additional charges.

4.4 Refunds: Refund policies vary by service and will be outlined in the project agreement. Generally, advance payments are non-refundable once work has commenced.

5. Intellectual Property Rights

5.1 Client Ownership: Upon full payment, the client will own the final deliverables, including source code and design files, unless otherwise specified.

5.2 Third-Party Components: Some projects may include third-party libraries, frameworks, or components that retain their original licenses.

5.3 Portfolio Rights: Biznix reserves the right to showcase completed projects in our portfolio and marketing materials unless explicitly prohibited by a non-disclosure agreement.

6. Client Responsibilities

The client agrees to:

  • Provide timely feedback and approvals
  • Supply necessary content, materials, and access credentials
  • Ensure all provided content is legally owned or licensed
  • Make timely payments as per the agreed schedule
  • Respond to communications within reasonable timeframes

7. Timelines and Delays

While we strive to meet all project deadlines, timelines are estimates and may be affected by factors including client feedback delays, scope changes, or technical challenges. We will communicate any anticipated delays promptly.

8. Support and Maintenance

8.1 Post-Launch Support: Free support periods are specified in each package and cover bug fixes and technical issues.

8.2 Ongoing Maintenance: Optional maintenance plans are available for continued support, updates, and enhancements.

8.3 Third-Party Services: We are not responsible for issues arising from third-party services, hosting providers, or external dependencies.

9. Warranties and Disclaimers

9.1 Service Warranty: We warrant that services will be performed with reasonable skill and care.

9.2 Disclaimer: Services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee uninterrupted or error-free service.

9.3 Browser Compatibility: We ensure compatibility with modern, updated browsers but cannot guarantee functionality on outdated or unsupported browsers.

10. Limitation of Liability

To the maximum extent permitted by law, Biznix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability shall not exceed the amount paid by the client for the specific service giving rise to the liability.

11. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the project. This obligation continues beyond the termination of the agreement.

12. Termination

12.1 By Client: Clients may terminate projects with written notice. Payments made are non-refundable, and fees for work completed will be due.

12.2 By Biznix: We may terminate services if the client breaches these terms, fails to make payments, or if we determine we cannot fulfill the project requirements.

13. Dispute Resolution

Any disputes arising from these terms or our services will be resolved through good-faith negotiation. If unresolved, disputes will be subject to the jurisdiction of courts in India.

14. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Continued use of our services constitutes acceptance of modified terms.
